Provisional Measure 764, issued at the end of 2016, brought to the fore a long-debated topic: the possibility of differentiating prices according to the payment method chosen by the consumer — whether with a credit card or in cash. Although it is a custom among merchants to offer discounts for paying in cash, consumer standards have always prohibited this practice. Furthermore, the aforementioned MP was riddled with questions about the real need for such a matter to have been the subject of a legal instrument of this type, since the arguments presented to justify the use of such a type of standard are not necessarily uncontested in terms of urgency and relevance of the topic, as recommended by article 62 of the Magna Carta. Government representatives justify the Buy Phone Number List adoption of such a measure in a variety of ways, including the fact that they consider it, in addition to being advantageous for the consumer as they can pay less upfront, as a stimulus to competition between the various payment methods, capable of reducing costs. credit card interest and regularizing a practice that already exists in small businesses. They also state that there is the possibility of a significant reduction in the aforementioned rate, which will only depend on the completion of studies carried out by the Central Bank. Indeed, lower interest rates are of great interest to the consumer contracting the service of credit card administrators, however, wouldn't such an argument have greater consistency after completion of such studies, with the long-awaited reduction being unequivocally proven? It should also be noted that, for some years now, there has been a strong movement towards amending Federal Law 8,078/90, which established the Consumer Protection Code (CDC) in some aspects, having already been discussed in the Federal Senate some bills in this regard. Wouldn’t the National Congress be the most appropriate “forum” to consider the content of such a measure? Despite the importance of such reflections, let us leave aside the political issue, as it does not represent the real objective of this article.
